DISTANCE SALES AGREEMENT

2. DEFINITIONS

  • LAW: Law No. 6502 on Consumer Protection.

  • REGULATION: Regulation on Distance Contracts.

  • SELLER: The person providing the product/service (Kaan Fidan - No Apologies).

  • BUYER: The person purchasing the product.

  • SITE: The website owned by the SELLER at www.noapologiesstudio.com.

  • AGREEMENT: This contract made between the SELLER and the BUYER.

3. SUBJECT

This agreement governs the rights and obligations of the parties concerning the sale and delivery of products ordered by the BUYER from the SELLER’s website, in accordance with Law No. 6502 and relevant regulations.
Prices on the site are valid until updated. Promotional prices are valid during the specified period.

6. PRODUCT INFORMATION

The ordered product(s), quantities, and total price are specified in the order form and approved by the Buyer.

7. PRODUCT DELIVERY

The Seller undertakes to deliver the ordered product(s) to the address specified by the Buyer at the time of the order, within a maximum of 30 (thirty) days from the conclusion of the contract.

Delivery time may vary depending on stock availability, supply processes, and the shipping company’s operations.

The Seller is obliged to immediately inform the Buyer about any delays during the delivery process.

In case the product is damaged or incomplete at delivery, the Buyer is obliged to have the cargo officer prepare a report and immediately notify the Seller.

The Seller is not responsible for damages or delays caused by the shipping company after delivery; however, the Buyer’s rights remain reserved.

8. RIGHT OF WITHDRAWAL

The Buyer has the right to return the product received within 14 (fourteen) days without giving any reason and without paying any penalty.

Returned products must be unused, in their original packaging, and undamaged.

To exercise the right of withdrawal, the Buyer must notify the Seller in writing (by e-mail or letter).

9. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal cannot be exercised for products prepared according to the Buyer’s special requests or personal needs.

Products that cannot be returned due to hygiene reasons are excluded from the right of withdrawal.

Products with opened packaging, used, or damaged will not be accepted for return.

10. RETURN PROCESS AND CONDITIONS

The Buyer must notify the Seller in writing within 14 days from the date of delivery if they wish to use the right of withdrawal.

The product to be returned must be unused, in its original packaging, and undamaged.

Return shipping costs are not the responsibility of the Seller; shipping costs must be borne by the Buyer.

Upon receipt of the returned product, the Seller will refund the amount paid by the Buyer within 14 days, subject to evaluation of the product’s condition.

If the product’s value has decreased due to use or damage, the Seller may deduct the amount corresponding to the depreciation from the refund.

11. WARRANTY AND RESPONSIBILITIES

The Seller is liable within the scope of the Turkish Commercial Code and Consumer Rights Law for defective or faulty products.

The Buyer is obliged to notify the Seller within 30 days from delivery if any defect or fault is found.

The Seller has the right to replace, repair, or refund defective products free of charge.

Natural wear and tear or damage due to use are excluded from the warranty.

12. JURISDICTION AND DISPUTE RESOLUTION

In disputes arising from this agreement, Consumer Arbitration Committees or Consumer Courts at the Buyer’s place of residence shall have jurisdiction.

The parties agree to seek amicable solutions before resorting to litigation.

13. EFFECTIVENESS AND ACCEPTANCE

By placing an order on www.noapologiesstudio.com, the Buyer is deemed to have accepted all provisions of this Distance Sales Agreement.
